Definitions The owner means the owner
of the property, which is the subject of the booking, or his
authorized representative in Portugal. CM means CM-Algarve Holidays
the owner of the property. The customer means each customer
booking a property with the owner CM.
Bookings
When you make a booking,
you must complete a booking form, accepting on behalf on all your
party the terms of these booking conditions.
When you make your booking
you must bay your deposit of 30% of the total rental. This is a
non-refundable deposit. A contract will exist as soon as
we issue confirmation to you. The balance is due 6 weeks prior to
your departure and if not received in time, we reserve the right to
cancel your holiday, retain your deposit, and apply cancellation
charges.
Alteration by the
customer
If, after our confirmation
has been issued, you wish to alter any of the arrangements made, we
will do our best to accommodate your wishes and a charge of €25,00
per alteration will be made plus any further costs we may incur by
making this alteration. You should be aware that these costs
increase closer to the departure date that changes are made and you
should contact us as soon as possible.
Cancellation by you
Should you wish to cancel your
holiday, the person who signed the booking form must make the
cancellation in writing. As this incurs administrative costs, we
will retain your deposit and in addition may apply cancellation
charges to the maximum shon below.

Alterations by us
The arrangements featured
in our brochure are planned many months in advance and changes can
occur for a variety of resons after we have published the brochure.
Most would be minor in nature and should not affect your holiday
enjoyment. We will do our best to advise you of any changes either
at the time of booking or before departure. However, somtimes a
major alteration has to be made to your booking. In this event we
will notify you as soon as possible and you will have the option of:
(a) accepting the changed arrangements, (b) cancelling your holiday.
if you elect to cancel, we will refund all monies paid to us.
Important note:
Compensation payments do not apply to changes caused
by force majeure i.e. war or threat of war, riots, civil strife,
terrorist activity, strikes or other industrial disruption, natural
disasters, fire, technical problems with transportation, airport
closures, quarantine, epidemics, weather conditions, movement action,
or other events beyond our control. Should changes become necessary
during your holiday for reasons of force majeure, we cannot accept
responsibility for any loss, damage or expense and no refunds will
de given.
Cancellation by us
Unfortunately we must reserve
th right to cancel. However we will only cancel after the date your
balance is due if: (a) You have failed to pay the final balance or
(b) As a result of circumstances beyond our control i.e. we are
unable to provide the holiday booked in which case we will refund
all monies paid or offer an alternative holiday of comparable
standart. In addition we will pay compensation as set out the
paragraph above, except if the cancellation is forced by "force
majeure".
Price quotations
All the price quoted are based on prices,
taxes and exchange rates at the time of publications and whlst
accommodation rental prices will be maintained for the season ahead,
other prices quoted may be subject to variations due to changes in
taxation or exchange rates introduced after publication.
Passport and visas
it is your responsibility to
be in possession of a valid 10-year passport and any visa which may
be necessary. If you hold any other passport please contact your
appropriate embassy. It is the responsibility of the guest to ensure
that their documentation is in order.
Complaints
If during the course of your holiday you have
any reason for complaint or dissatisfaction, you must contact our
agents or accommodation managers who will do their best to solve any
problems on the spot.
Liability
the owner CM are not
responsible in any way for the loss or damage of any goods or
personal belongings of customers. The owner CM will be under no
liability whatsoever in the event of a cancellation, withdrawal or
alteration of any arrangements or any losses or additional expenses
caused by reason of war, civil strife, strikes, sickness, quarantine,
dab weather conditions, natural disaster, technical problems of any
description, terrorist activities, closure of airports, ot other
circumstances beyond the reasonable control of the owner CM. The
owner CM shall not be liable for any injury, sickness, loss, damage
or additional expenses or inconvenience directly or indirectly
arising out of the design, structure, use or condition of any
buiding or premises, their approaches or contents or mechanical and/or
electrical services belonging thereto or out of any therein. The
owner CM will not in any circumstances whatsoever accept
responsibility for loss of life, personal injury, illness, or loss
or damage to baggage or personal effects or consequential loss other
than for the negligence of their respective employees acting in the
course of the emplyment. The owner CM connot be held liable for any
actions of any persons (Other than for negligence of an employee of
each of them acting in the course of the employment) or the failure
of any public services or supplies of a technical nature connected
with the holiday arrangements over which they have no control.
Other details
All our apartments have
television. Portuguese TV show English/American programmes/films in
English with Portuguese subtitles.
No over accupying in any
property will be accepted, your paty size as quated in your
confirmation/booking form should remain the same.
Any disruptive guests will be
issued with a verbal warning, where applicable, and if the problem
continues the client will be asked to leave the property.
Please not that you are kindly
requested to vacate your apartment at 10.00 a.m. on your day of
departure, so maids may prepare for the arrival of incoming guests.
Your apartment will usually be ready upon your arrival from 2 p.m. |
